Terms of Service

By using DPDPA Shield, you agree to these Terms and our Privacy Policy. If you're accepting on behalf of a company, you confirm you have the authority to bind that entity.

Don't agree? Don't use the platform.

DPDPA Shield is a compliance management platform delivered as SaaS. It includes tools for consent management, rights request processing, breach incident management, compliance health monitoring, data inventory, policy management, and more.

Important: We provide tools to help with compliance. You remain the Data Fiduciary responsible for your organisation's compliance under the DPDPA 2023. Using DPDPA Shield doesn't guarantee regulatory compliance, and we're not your legal counsel.

Access is provided by invitation or through a demo request. You need to provide accurate, current information when registering. Keep your credentials secure - you're responsible for all activity under your account.

If you suspect someone has accessed your account without permission, let us know immediately at hello@dpdpashield.in.

You may not:

• Use DPDPA Shield for anything unlawful or in violation of applicable law
• Reverse-engineer, decompile, or disassemble any part of the platform
• Resell, sublicense, or distribute access without a written reseller agreement
• Circumvent plan limits or access controls through technical means
• Upload malicious code, conduct security attacks, or try to gain unauthorised access
• Process personal data for purposes unrelated to DPDPA compliance

DPDPA Shield is offered on annual subscription plans. Your subscription auto-renews at the end of each billing period unless you cancel before the renewal date.

If you cancel, it takes effect at the end of the current period. We don't offer refunds for unused portions of annual subscriptions. Any price changes will be communicated at least 30 days in advance via email.

You own your data. We process it only as instructed, per our Data Processing Agreement and Privacy Policy.

If your account is deleted or your subscription ends, we'll purge your data within 30 days - unless applicable law requires us to retain something longer.

The DPDPA Shield software, interface, documentation, and all associated IP belong to us. Using the platform doesn't give you ownership of any of it.

You keep full ownership of everything you upload to DPDPA Shield. You grant us a limited licence to process that data solely to deliver the services described here.

We may use anonymised, aggregated usage data (nothing personally identifiable) for product improvement and benchmarking.

We target 99.5% monthly uptime. If we need to do planned maintenance, we'll give you at least 48 hours' notice via email or in-app notification.

We're not liable for downtime caused by AWS infrastructure issues or events beyond our reasonable control.

To the maximum extent permitted by Indian law:

• Our total liability for any claim is capped at the fees you paid us in the three months before the claim arose
• We're not liable for indirect, consequential, special, incidental, or punitive damages - including lost profits, data, or goodwill
• We don't warrant that DPDPA Shield will be error-free, uninterrupted, or that it'll meet your specific legal requirements

Either party can terminate the subscription at any time. We may suspend or terminate your account for material breach of these Terms, with notice where practicable. For serious violations (security attacks, fraud), we may terminate immediately.

Once terminated, your access stops. We'll keep your data for 30 days so you can export it, then delete everything.

These Terms are governed by Indian law. Any dispute will be subject to the exclusive jurisdiction of the courts in New Delhi, India.

We may update these Terms from time to time. Material changes get at least 30 days' email notice. If you keep using the platform after that, you've accepted the update.
